  • How can intellectual property law limit the right to quote?

The Art 32.1 of TRLPI authorizes us to include in one's own work written, audio or video fragments of other authors, as well as isolated  plastic works or figurative photography, provided that such works have already been disclosed and their inclusion is made by way of quotation or for analysis, review or critical thinking, for teaching or research, indicating the source and the author's name.

 

  • Can I include in my work fragments of the works of others without asking for permission?

Yes, if it meets the following conditions:

  • should be fragments of works already published.
  • be made by way of quotation or for analysis, review or critical thinking, for teaching or research.
  • not forgetting to state clearly the source and the author's name .

 

  • In order to include a other's photo, do I need the author's permission?

You do not need permission from the author when:

  • Photography is in the public domain. In the case of artistic photographs, they will pass into the public domain after seventy years from the death of the author, and if they are simple photographs, there will be twenty-five years.
  • Also photographic works may be reproduced in teaching or research papers, indicating the source and the author's name, provided that such works have already been disclosed.
