1.- What is the plagiarism?

According to the Royal Spanish Academy to plagiarize is to copy in the substantial extraneous works, giving them and own”.

Like the Royal Spanish Academy, the Doctrine of the High Court understands by plagiarismall that supposes to copy extraneous works in the substantial”. Likewise, it expands the definition of the concept when presenting the plagiarismlike a material activity mechanised, little creative and carente of originality, although it contribute some demonstration of wit”. Concluding that “the concept of plagiarism has to refer to the basic structural coincidences and fundamental and no to the accesorias, added, overlapped or transcendental modifications” (STS núm. 12/1995 of 28 of January)

2.- Which elements define plagiarism?

  • The total or partial no authorised copy of an extraneous work
  • The presentation of an extraneous work and own, suplantando to the true author

3.- When is it plagiarism?

It is plagiarism when a work is disclosed, published and reproduced to name of a distinct author of the true. It attacks the moral and economic rights of the author, as it usurps his authorship and defrauds his economic interests.

4. Which works can be plagiarized?

Go back to the start of the pageIt will be able to be a literary work, scientific or artistic eat:

  • The books, folletos, printed matter, writings, reports, conferences…
  • Musical compositions, with or without letter
  • Dramatic works, musical, choreographies and, in general theatrical
  • Cinematographic and audiovisual works, multimedia works, photographic works
  • Sculpture, painting, drawings… and other plastic works
  • Architectural works and of engineering
  • Programs of computer and databases
  • Forms of drawings, signs, models, patents, marks, lemmas and sentences divulgatorias of objects produced by the industrial arts

5. Examples of plagiarism…

  • Copy a work and present it like own, independently that the copy was total or partial. If the work is protected by the Right of Author, will not be notable if it has copied a lot or little of her so that it exist plagiarism.
  • Reproduce a text in my work without doing reference to his author.
  • Include sentences, paragraphs or ideas of others in our writings, without quoting his procedencia or author.
  • Copy paragraphs or sentences of sentences without signalling his procedencia.
  • Parafrasear Of unacceptable form a text or an idea, without quoting his author.
  • Buy a work to another, to the that calls him “black”, and present it like own.
  • Present an ours work already used: we spoke of “autoplagio”.
  • Copy any multimedia work (audio, video, Webs…), music, charts, without quoting to the author.

6. Why is plagiarism an offence?


  • Because the Law of Intellectual Property recognises to the author:
    • The right irrenunciable and inalienable to demand the recognition of his condition of author of the work (Art.14.3)
    • The exclusive exercise of the rights of exploitation, as the reproduction of the work, that can not realise without his permission (Art.17)
    • The judicial actions to demand the compensation by the material and moral damages ocasionados by the act offender (Art.138)
  • And the Art. 270.1 of the Penal Code includes the plagiarism like a crime against the intellectual property, when it realise ”without the permission of the headlines of the corresponding rights of intellectual property or of his cesionarios”.

7. When there is not plagiarism?

  • When we express or we present ideas and original works
  • When we spread and we reproduce public knowledge
  • When we present the results of an original investigation

8. How I can avoid the plagiarism?

Quoting

If in my work quote literally a sentence or a paragraph, have to put the text between comillas, in cursiva or with another type of letter and quote the source of where have extracted it, with the complete bibliographic reference.

¿What has to quote ?

  • Data, figures, statistics that are not of common knowledge.
  • Theories or specific ideas that have been proposed by other people.
  • Any specific information that was not of public knowledge.
Paraphrasing

If I use the ideas of another person using my own words or my own form of expression, have to include the complete bibliographic reference of the original source of where have extracted the ideas.

Councils for parafrasear:

  • It reads the original text attentively, extracting key words and sentences that resuman the approach.
  • Express it with your own words. You can:
    • Use generic words
    • Use synonymous
    • Change of active to passive, or vice versa
    • Change the structure of the sentence
    • Reduce paragraphs to sentences
    • Change parts of the text
  • It compares your sentences with the original and ensure you that the information is faithful, and do not use accidentally the same sentences or words.

I have to quote so much the bibliography consulted like the extraneous works (or fragments of them) incorporated in my work, already are of nature written, audible or audiovisual, or images, photographies, etc.

11. What can do if I recognise that somebody has plagiado my work?

As the general rule says that “it will boast author, except proof in contrary, to who appear like such in the work”, will correspond me to me like author and headline of the moral rights, exert the timely actions so that it recognise the paternity on my work (Arts. 6.1 and 138 of the Law of Intellectual Property).

If it does not exercise action any by the author of the work, will follow boasting the autoría of that that by means of his name, signature or sign identify like such.

If the plagiarism realise with spirit of lucre and in perjuicio of third, will consider a crime of plagiarism of the Art. 270.1 of the Penal Code, then it will be able to be reported by any person that have knowledge of his realisation.
